The Constitution Will Be Discussed Hastily Over the New Year’s Table. Experts Explain What Is Wrong with This Plan

Since many amendments are planned for the Constitution, and given the importance and complexity of adopting such a document, more time than currently envisaged should ideally be allocated for a full discussion and the further preparation of the final version, agrees Andrei Kazakevich, director of the Political Sphere Institute.

The political analyst links the delay in familiarizing the public with the proposed amendments to the fact that Alexander Lukashenka, who must approve the final version of the draft, has still not decided what kind of political system he wants to build.
— This especially concerns the All-Belarusian People’s Assembly, whose role is quite difficult to enshrine in the Constitution.

We have heard references to the idea that this body should ensure continuity between generations and serve as a safeguard in case “the wrong forces” win elections.

Creating such a body and granting it powers means that these powers must be taken away from other branches of government, primarily from the president, thereby weakening his role.

Apparently, there is an attempt to invent something innovative, and this creates difficulties, the political analyst says.

The second factor that has affected the delay in preparing the draft Constitution concerns previously undefined transitional provisions, which will determine when different constitutional innovations come into force and when powers are transferred between state bodies.
— There are many transitional provisions that will have substantial political significance.

It is one thing if all of this is implemented immediately, and quite another if it is postponed for a year or five years, Kazakevich comments.
